A. Purpose /Role of the job: Describe in 1 phrase what contribution the job is expected to make to the organisation’s objectives

  • Direct Tax Specialist India is responsible for all India Direct tax aspects relevant for the domestic as well as for the overseas group companies.
  • This Position needs to ensure India direct tax compliance and tax strategic matters are properly managed, executed and taken care off.
  • The position is responsible to ensure for the India full Transfer Pricing (TP) Compliance and efficiency, i.e. that required formal TP documentation is prepared in time and to the required standards, that TP calculations performed by Business Partnering are in line with ICTP Guidelines and that TP matters scrutinized in tax audits are best defended from a technical point of view. Position  support the Global Head of Group tax with all matters relevant from central shareholder prospective and with a cross-regional scope like the ICTP related governance and documentation tasks as well as any other global relevant tax matter.
  • The role is an integral part of the India Tax team and based out of Vadodara.

B. Environment/Context/Complexity of the job: Describe the most important internal and external factors influencing the job

  • The compliance element of the job requires a very broad knowledge of India direct  tax law, Transfer Pricing regulations and fair knowledge of Indirect tax
  • The role is expected to meet all compliance requirement i.e statutory return filling, transfer pricing assessments, corporate tax assessments, fair understanding and experience of dealing with higher tax authorities and various court level wherever required.
  • The role also encompasses a significant tax risk mitigation work and projects to develop and implement new tax optimisation strategies for the company. This requires strong conceptual and  project management skills, the ability to brief, seek proposals from, evaluate, negotiate with and select international advisory teams (usually from a Big 4), and to subsequently manage these teams to achieve the required outputs within tight time lines and budgets.
  • The job holder has to collaborate and work with most corporate functions and also with all areas of the India business as well as with tax experts in other regions. 

C. Responsibilities/ Accountabilities of the job: Describe the main results expected from the job

The responsibilities and accountabilities comprise of the following processes and sub-processes:

this position is responsible for tax compliance and strategy in India, i.e for ensuring that all aspects of direct taxation in India. including both Corporate Tax and Transfer pricing are technically correct, performed on time and generate the best value for INEOS Styrolution. Position based out of Vadodara office.

  • Corporate India Income tax returns computation, filling and assessments
  • Handling various tax audits including Form 3 CD, Form 3CB etc.
  • Ensure all tax payments by due dates
  • Handles all tax aspects of strategic projects and assist from tax prospective.
  • Prepare direct tax strategy and implement in best interest of organization
  • Set up process as per transfer pricing rules
  • Represent organization and work closely with big 4 for various tax matters related to direct tax, and Transfer Pricing.
  • Ensure SAP and other IT tools set up as per changes required under  local tax law.
  • Coordinate with cross functional & global tax team for various transfer pricing documentation for India transfer pricing audit & assessment.
  • Timely track changes in law, implement and give understanding to all concerned
  • Mitigate Risk of tax by timely taking actions
  • Work closely with Finance team and statutory audits from correct tax accounting  prospective
  • Work towards successfully closure of tax assessment and pending demands
  • Tax planning and ensure compliance with all business process changes
  • Monitor tax payments and timely returns submission
  • Timely and accurately local statutory financial report system development
  • To prepare APA whenever required and ensure it is awarded
  • To coordinate with Asia Pac Business Partner function and Global Tax function  to ensure compliant operational intercompany transfer pricing and documentation (ICTP).
  • To plan, coordinate and document for RHQ / GHQ services / cross charge
  • The Transfer Pricing task requires to  work together with the other members of Global Transfer Pricing Team and the regional Asia finance team on various transfer pricing related topics and projects from making sure compliance with applicable regulations and law is ensured, operational TP calculations are meeting the ICTP Guideline, support in the case of any questions coming up with regards to TP matters and  to provide strategical and tactical input  for best tax risk mitigation , while focusing on the India / Asia region

    The job requires internal interfaces with a wide range of departments (Finance, SCM, Regional Business Management etc.) including operational as well as  senior management level and external interface with outside counsel and consultants, tax authorities and other (governmental) institutions.

  •  -Manage and support  Transfer Pricing audits and Transfer Pricing exposures (in both transfer pricing specific audits and regular tax audit) in India;
    -Participate in the quarterly tax operational ICTP alignment calls  in order to ensure correct determination of transfer pricing positions in APAC ;
    -Review India tax structures in light of changing international transfer pricing regulations (e.g. OECD Transfer Pricing Guidelines and BEPS) and local legislations in APAC countries;(Need based)
    - - Manage transfer pricing implications of designing and implementation of (changes in) a new operating model within a multinational company.

F. Required profile:

Level of education & Knowledge:

  • Chartered Accountant

Language skills

  • Excellent English communication skills (written and oral)- essential

Experience in general:

  •  7-8 years’ experience preferably in manufacturing setup and similar role in reasonable size of organization.
  • Specilised experience in Corporate tax, and working knowledge of Indirect tax
  • Experience in Transfer Pricing work, operational transfer pricing, transfer pricing documentation and transfer pricing tax audit defence or litigation.

Technical skills:

  • Competent user of Word, Excel, PowerPoint and other databases
  • Working knowledge of SAP.
  • Knowledge of IND AS & IFRS GAAP (Generally Accepted Accounting Principles) an advantage
  • Excellent understanding of Direct Tax, and TP.
  • Excellent in Internal control processes.
